Terms of service and data information

1. Service

EV-ES Cloud lets owners of compatible EV-ES devices view telemetry remotely, manage devices and use features available under an active subscription.

The service is informational and supplementary. It does not replace device protections, electrical-installation protections, manufacturer instructions or a qualified safety assessment.

2. Account and user responsibility

The user must provide a genuine email address, protect their password and not share the account with third parties. Suspected unauthorized access must be reported promptly to cloud@ev-es.pl.

The user independently decides which devices to pair with Cloud and uses the features available through their own account.

3. Devices, data and commands

Once paired, a device may transmit its serial number, name, connection status, battery measurements, events and errors. Telemetry may be used in aggregated form or without a direct link to a user for statistical and analytical purposes, including development of battery-health algorithms and improvement of software and features useful to users. Detailed telemetry linked to a specific account or device is available to EV-ES administration only after the user has explicitly enabled such access in Account settings. The permission can be turned off at any time and does not limit the core Cloud service.

The administrator has no access to user passwords in plain text; passwords are stored only as cryptographic hashes. The administrator has no feature allowing them to independently manage or control a customer’s device through Cloud, and does not use Cloud to monitor maintenance, safety, support or development of an individual customer device. Commands available in Cloud are initiated by the user from their account, and their execution depends on network connectivity and device state.

4. Subscription, payments and availability

Cloud features may require an active subscription. The administrator may perform maintenance that temporarily limits access. To the extent allowed by law, the service is provided with due care but without a guarantee of uninterrupted availability.

A subscription may be cancelled, renewed or changed in scope at any time. Subscription payments are not collected automatically. Each purchase, renewal or change of subscription scope requires the user to submit a separate request and make a manual payment in accordance with the supplied instructions. The service does not automatically charge a card, bank account or any other payment method.

5. Data controller and processing purposes

The controller of personal data is M-LOAD TECHNOLOGIES sp. z o. o., ul. Orzechowa 21, 08-307 Repki, the operator of EV-ES Cloud. Contact for service and data-protection matters: cloud@ev-es.pl.

We process account data (email and login data), technical data necessary for operation of the service (such as logs and IP address), and device telemetry. We do so to create and operate the account, provide the service and billing, carry out aggregated statistical analysis, and improve Cloud software and features. If a user voluntarily enables detailed telemetry access in Account settings, EV-ES administration may view it only in read-only mode for those analytical and development purposes. Depending on the purpose, the legal basis may be performance of a contract, a legal obligation, the controller’s legitimate interest, or consent.

6. Retention and rights

We retain data while the account and service are used and afterwards for the period needed to meet legal, billing or claims-related obligations. Where applicable, users may request access, rectification, erasure, restriction, portability or object to processing. Users may also lodge a complaint with the competent data-protection supervisory authority.

7. Changes

The administrator may amend these terms for important reasons, including changes to law, security or service features. A new version will be published in Cloud with its effective date.
